Gay Adoption in Florida (2020)
LGBTQ Floridians who want to adopt have had a long and arduous legal and political battle. With the election of Joe Bident for President, President Obama’s Order establishing Gays as a protected class will continue to be in force. Notwithstanding, the LGBTQ community continues to pressure both legislators and courts throughout the country to protect and advance their rights to both foster and adopt.
What’s going on in Florida regarding Gay Adoption?
Florida’s ban on gay and lesbian adoption was ruled unconstitutional in 2010. Shortly thereafter, on June 5, 2015, Florida officially removed the unconstitutional law.
Since 2010, hundreds of parents have been able to adopt the children they have been raising, and they now have the ability to legally protect and care for their families. Many children stuck in foster care have benefited.
Excluding LGBT+ couples from adoption limits the number of potential homes for needy children, as gay men and lesbians are more likely to adopt.
About 400,000 children are in foster care in the United States, about a quarter of whom are waiting to be adopted, according to U.S. government data.
According to a 2018 study by the University of California’s Williams Institute, 21% of U.S. same-sex couples adopted children and 3% fostered – seven times as many as that of straight couples.

Child Welfare Information Gateway provides a nationwide Adoption Directory to search for support groups for prospective and adoptive parents.The University of Central Florida is another excellent source of information.
