Divorce Outside the Box


The parties are free to agree to a lot of things that the court cannot consider. When parties try to resolve a case, they’re free to think outside the box. They can agree.

I love that idea. Thinking outside the box. That’s great.

They can agree to things that the court can’t do. When you go to trial, the court is supposed to rule within the law.

Now the courts have discretion to grant or deny certain relief. But they are also supposed to follow the law and stay within the box while, while they may want to be creative and try to help out one or both parties. That’s not really the court’s position. So the court has to stay inside the box, whereas the parties can agree to things outside the box.
