Do Threats Affect the Divorce


Threats made by one party or the other, such as I’m gonna take the kids in a divorce. Doesn’t help the parties in any which way. It creates more animosity, it creates more litigation, and especially now that you have a 50/50 presumption. The odds of somebody taking the children when both parents, assuming they’re good parents, they’re gonna end up with 50/50 timeframe.

So that threat became a veil threat with a new statute in place. Before the statute was in place in 2023, there was no presumption in favor or against 50/50. A lot of courts were going that way, and a lot of the rulings were that way. But there was no ball in the books until then.
