Are you facing a “Paternity Action”?


When you get divorced and you have children, or if you have children and you’re not married, it’s called a paternity action. Either one is governed under Florida law with regards to establishing a parenting plan. The parenting plan talks about daily communication when we’re with the other parent, how you’re gonna handle the day-to-day activities of a child.

But most important for most people is the time-sharing schedule. The party that doesn’t want 50/50 and wants more time has to weigh on a case as why that’s in the best interest of the minor child or children to that party to have greater than 50%, and it’s their burden to overcome the presumption, whereas before there was no burden either way.
