Jolie vs. Pitt – And The Decision Is….

In September of 2020, we discussed the advantages of the use of private judges in divorce litigation. In that article, we shared recent reports of the Jolie vs. Pitt divorce. Jolile sought to have their private judge removed, claiming an undisclosed conflict of interest. Clearly, Jolie was having buyer’s remorse.

According to a Fox News article published on November 18, 2020, Ms. Jolie’s motion was denied by a Los Angeles Superior court judge.

Ms. Jolie’s attorneys attempted to remove John W. Ouderkirk, who presided at their wedding,  for failure to fully disclose his business relationship with Mr. Pitt’s attorneys.

Not surprisingly Ouderkirk confirmed that was impartial and denied he failed to disclose.

Pitt’s attorneys characterized Jolie’s motion as a transparently tactical gambit to delay the proceedings.

As Fox acknowledged the trend among high profile couples is to hire private judges to keep personal and financial details of their lives private.

Jolie, Pitt, and Ouderkirk agreed that Ouderkirk could and would serve impartially. Perhaps it would have been better to have picked a qualified judge that either party knew.

If the judge presiding over their wedding, it is not mere speculation to assume there was a close relationship among them. Consider the sense of betrayal if either or both parties’ expectations are not met? Would Ouderkirk have been better off declining the appointment? I doubt he will be invited to dinner by either party when this is over.
