Alimony 101


We talk about alimony a lot in a lot of our consultations, and the most important thing for the parties to understand is right now in the state of Florida, Florida has eliminated permanent alimony. So even if you have a long-term marriage, there is no such thing as permanent alimony. But it’s important for people to understand that alimony is not to be used to fund every luxury enjoyed during the marriage, but really, how much does a person need to meet their reasonable needs as established during the length of the marriage?

In the state of Florida at the current time, with the most recent statute change, there is a formula to help guide the courts as to the maximum amount of alimony that the court can award. There’s always a minimum, but there’s also a maximum. So we always have to talk about what are their needs and the most important thing is, does one party have the need to receive and does the other party have the ability to pay. That’s step number one, if the court first finds that one party has a need to receive alimony from the other party and that the other party has the ability to pay alimony then the court considers the different types of alimony and the amount of alimony.
