Does the Length of the Marriage Matter?


The length of the marriage does matter. That would dictate whether the marriage is a short-term marriage, a moderate-term marriage, or a long-term marriage. And the length of the marriage is defined as the date, from the date the parties were married until the date an action for divorce is filed. Now there are specific factors in the various types of alimony that the court has to consider.

For example, in some forms of alimony, the court cannot consider a certain form of alimony if the marriage is less than three years in duration. Does that mean that a party would get no alimony? Possibly not. There’s another form of alimony to look at. So there are different factors that an experienced family attorney would consider when counseling a client on alimony, whether the marriage is a short-term marriage, moderate-term marriage, or a long-term marriage.
