Who Pays for Private School?


So private school payments are not considered in base child support, private school tuition and related expenses through high school graduation are considered a luxury. There are a certain set of facts that the court can consider whether it should order a child to attend or stay in private school, such as, is the private school in the customary standard of living of the parties? Can the parties continue to afford private school once they’re divorced? And is it in the minor children’s or child’s best interest? If so, the court would have the authority to order the parties to contribute to the private school tuition and related expenses pro rata based upon each party’s net income to the combined total monthly net income. With respect to college in the state of Florida, the court cannot order either to pay for college expenses or any post-majority expenses.
